chat with an activist who has had some experience getting arrested during direct actions over the years. He tells me that during the Mayor Dinkins and Koch years, things weren't so bad, you'd get out fairly quickly, usually under 12 hours. When Guliani took over things became much different. He tells me that you get busted for simple possession of pot and expect to spend 3 days in the Tombs before seeing a judge. Part of Guliani's 'quality of life' initiative and all that. We talk a bit about different pleas and that's when I learn about ACD, which stands for Adjournment for Contemplation of Dismissal. ACDs are common outcomes in civil disobedience cases or situations where the charge is simply a violation. If the district attorney offers an ACD and you accept it, there is no judgement of guilt, but you have to avoid being charged with the same violation for the next 6 months. If you are charged, they can reopen the initial case and try you. Mr. Activist Dude tells me it's very rare that happens. Most of the time the city doesn't want to bother opening old cases, just too much work. He tells me has gotten 5 ACDs over the years.

There is a persistent story making the rounds that Guantanamo on the Hudson was a facility leased by the RNC for the NYPD to use. If this is so, we are seeing the first concentration camp of this administration. Can anybody verify the story about the RNC being the legal lessee of the facility?

Hey....I used to live in SF but don't think we ever met even though we ran in the same circles...

Anyway, I am glad you listed your account. It is extremely important for facts to be publicly presented about what happened during the RNC. Even more so, the facts happening right now about the Bush administration and their tactics. Shockingly (or not), the media has all but ceased to cover any followups to the harassment and incarceration of protesters.

Bush has a wide ugly wingspan and it is imperative voter turnout happens in November. Too many people are feeling worn down at the moment and are less likely to vote. Keep spreading the message that change must happen.

I don't know why you were there, you didn't say .
I can't say I feel sorry for you but I do respect you for the truth in the story.
So many people protest and the media doesn't really explain their cause I wonder if its really worth it. You getting locked up cost you your time but it cost tax payers a lot of extra money.

Oh I am so sorry you had to be detained. It was a RNC convention, the Presidents life was in danger from raving lunatics. better a couple of peope who are "innoncent" get locked up, rather than a couple of crazies be loose.
In this world not everything can be perfect all the time. Being locked up for any amount of time is horrible, but believe me your all making a huge issue out of this. Why even be in a hot spot if you didnt think you might go to jail? just wondering....

I can't tell you how glad I am for what you did, and how much I wish I could have been there.

I hope your lawyers point out to the judge that a $500,000 penalty for locking up so many protesters is probably regarded by the RNC as a cost of doing business and money well spent. I wouldn't be shocked if they actually budgeted for it ahead of time--the plans to violate your rights certainly seem to have been well-thought-out in advance. Per CNN at http://www.cnn.com/TRANSCRIPTS/0408/27/lad.03.html (page still working as of 9/7/04), "The proposed budget for the Republican national convention is $64 million, EXCLUDING SECURITY [emphasis supplied]. But the final price tag may be even higher. The New York host committee's fundraiser say they've collected about $70 million in private donations."

This is a pet peeve of mine--penalties meted out that sound impressive until you consider the resources of the transgressor, at which point it becomes obvious that the hand-slap administered was never meant to do more than keep up appearances.

I was arrested in the same group that you were, it sounds like. I was in custody for 48 hours, never saw a lawyer. Thanks for the detailed account...I had forgotten a few things.

Sounds an awful lot like my story, except that I never got to see a judge, and spent "only" 30 hours in jail. Hang in there and join the civil suit.

Couldn't have imagined you'd wind up sleeping on a toxic floor being herded around and detained for nearly 2 days. Glad to hear, most of all, that you got all your content back. See you round.

What happened to you was really unfair and unfortunate. I hope you are able to get justice for your illegal detention. But I do hope you realize that the treatment and holding conditions were well above average for an arrest. Most people experience far worse when they get arrested for even very minor offences.
