I don't think Josh "owned" Colbert at all. Colbert proved to be absolutely hilarious in his exchange with Josh. Josh was good and did respond like the intelligent guy he is, pointing out basic first amendment rights but Colbert was entertaining and this is his show. He made me laugh.
